Live in Florida and have a credit card judgement against me. I was sent a schedule "A" form to fill out and return. Have a couple of questions: 1. If I don't do it what will happen? 2. Can they garnish my husband paycheck? 3. Can they touch our checking account? 4.. Can they touch our childrens savings account? My husband is not apart of the credit card.
State/Country relating to Question: Florida Already Tried: Nothing. Don't have money to pay for the judgment. Also, don't have the money to file Bankruptcy yet.
HiCustomer Thank you for asking your question on JustAnswer. The other Experts and I are working on your answer. By the way, it would help us to know: -Who sent you the schedule A and was it by certified mail or signed by a judge? Whose SSN is on your children's bank accounts? Is your account joint with your husband? Thank you again for trusting us with your problem. Please reply as soon as possible so that we can finish answering your question.
Sent by County Court of Broward County with case number XXXXX by attorney for the plaintiff. I am sure my social security number is XXXXX the childrens accounts. Yes my account is joint with my husband.
Any account with your SSN is subject to attachement so you may want to get the money out now. This request is permitted once a judgment has been issued. Assuming your husband's name is XXXXX XXXXX the judgment his wages cannot be garnished. You may want to try to either get a payment plan set up or possibly seek protection in the bankruptcy court. If I cannot pay it should I send it back in? They want my husbands information including social, taxes for last two years, etc. Is that something they can do?

If he is not on the judgment I would refuse to provide any information on your husband. If it is not signed by a judge it is not a court order so you can ignore it until you are actually ordered by the court to produce it. since I haven't seen the document I don't want to give you any incorrect information so it is safer to at least send it in, even if you don't fill it out completely.

Dave
