my aunt in Freeport New York was left in her home for two days in her own urine and feces while her son came and went as if nothing happened. She has two children who are very disturbed one is in a mental hospital and the other had problems since leaving the military years ago...and this is the one that left her in the hospital. there is an order of protection on her from the information we gained from the doctor. in order for us to get a police report they told us that we needed a lawyer and how do we go about getting POA? She is still in the hosptial on life support.
State/Country relating to Question: New York Already Tried: Tried contacting lawyers in the area and a previous judge that she has dealt with in dealing with the issues with her two sons. Went to police department to get police report and was told we needed a lawyer. We weren't from New York, but from Georgia and SC and we were trying to get things done to better help my aunt.
Thank you for contacting our JA team for guidance.
Since she cannot grant you Power of Attorney, you have to file a petition to obtain guardianship/Conservatorship over her and her affairs. She would be declared incompetent according to the physician's reports since she is on life support and the petition should be granted.
You should retain a family law attorney to push this through quickly for you. The state bar association can provide you with attorney referrals.
I am very sorry this has happened to a loved one. How horrible!
Please let me know if you need additional information.

should we try and get a lawyer from New York or could my aunt work with one in Atlanta? How do we find a family law lawyer?
You would need a NY attorney since that is the state where she resides. The state and county bar associations can provide you with attorney referrals. Look for ones that offer free consultations.
All the best to you and your family.
