I was teminated today for theft of intellectual property. I submited my two weeks notice on Monday as I had found new employment. I looked through our companies system and while poking around inadvertently requested a report. I had no idea I had done such or I would have cancelled it from the print queery. Turns out this report printed Wednesday (this morning) and I was promptly terminated alledging I had taken this information in the days prior. I tried to explain I had not gotten a print job nor had I taken any information. My former boss then called my future boss and informed him of the alledged theft. Is it within my former bosses legal rights to do this??
Your former boss does NOT have a right to do so. That is a violation of your privacy, and you have a valid case against the former boss for defamation (if you are found not guilty or not liable of committing theft), or if invasion of privacy and public disclosure of private facts (if you did indeed commit the offense). I urge you to quickly contact a workers right attorney and have him evaluate your chances on pursuing a suit. Sincerely, Dimitry Alexander Kaplun, Esq.
