I have a trailer that is on my business property that employees live in. No rent or even a lease aggreement has been established.. the current employee that lives in the trailer has been fired (for taking company vehicle after hours without permission) he has been arrested for outstanding warrants and public intoxication.. so here is my question, can we go in the trailer and clean his belongings out and put in storage since he will be in jail for the next few weeks.without his permission, even though the trailer is company property?
State/Country relating to Question: Texas Already Tried: We have done nothing so far. The problem i have is that this employee has a drinking problem and i am affraid that if he comes back on the property he might do damage.
If the housing was considered part of his compensation as an employee, he'd likely be considered a month-to-month tenant and entitled to 30 days notice to vacate. My suggestion is that you send him a 30 day notice to vacate in jail. Once the 30 days is over, if his things aren't out, you would need to file an eviction petition in Small Claims court. The judge will give you an order evicting him and permitting you to remove his things from the trailer. If he would agree to your doing this, it would bypass all of these legal hoops.
