Am I legal bound to pay for a subscription service even after I called and told them I wanted to cancel it. They are now threatening to use a third party collection service to collet the payment. They say they have a recording that says that I accepted the deal. The problem is that is for five years at about 3 times the amount I am paying now.
State/Country relating to Question: Texas Already Tried: Nothing. Contacted them to cancel subscription.
Courts bind parties to the contracts they enter into. If you agreed to the contract in a phone sale then they would be able to enforce that as a binding contract. Your only way out of the contract is prove they somehow have breached the contract with you, such as failing to provide the service or that they induced you to the contract by Fraud or misrepresentation. Absent showing they breached, the court would hold you liable to your contractual agreement.
