If a parent attempts to homeschool by themselves a 7 year old child who has had 2 strokes and has seizures but contacts the local school district who then says they don't have 'room' for the child, is the parent in violation of California's education code or any other law?
Already Tried: Last year my daughter tried to place her sone in the local district when she moved and was told they didn't have room at that time. Her son does not have the ability to sweat, has ectodermal displasia and total body hair loss (no eye lashes even). She tried to homeschool for the year but decided she is not being effective. The school district sent a Sherrif to her apartment at the end of the school year to find out why her son was not in school.... Now, she has been trying to get him in school and the school psychologist, who is the head of their SART, wants her to sign a paper stating that if her son misses even one day at school she will obtain a doctors written note. His doctors are at UCLA which is 1.5 hours away and my daughter is legally blind. Her son also has rheumatoid arthritis which hurts him and sometimes he runs 102 - 103 degree fevers with it.
HelloCustomerThere are apparently four options for home schooling your child in California. They are summarized Here. I am not a California attorney, so I really don't know the details other than what is presented in the summary. There may be exceptions for children with disabilities. You will probably want to look at the specific statutes of the California Education Code mentioned in the summary. If one of these options is not used, the parent presumably would be in violation of the compulsory education laws of California (California Education Code § 48200, 48400, 48410).I hope this helps a little.Thomas
