i recently asked a question about the state of texas and filing a lawsuit for not being able to get another job where i can make a liviing financially. i was hurt on the job, but didn't use my workman's comp because i couldn't say exactly what day the injury occurred, it was a gradual situation that happed to injure my achilles tendon, to this day, my doctor still has not released me because the injury still exists. this happened in early 2003, i've tried to reapply for my job, but human resources states on my reply letter that i need to get cleared from my doctor for the injury that i had.

i haven't tried anything as far as legal help. i was told by a social worker that since i was released from the state by what they called administration seperation, they were suppose to find me a job that paid me the amount of money that i was making while working with the state of texas (prison). my health is going down hill daily, and i have aged almost six years since this happened, and i'm at the point where i almost have to apply for my social security disability, which is something i don't want to do because i want to work, but i can't make a living working at walmart, i am killing myself everyday for 9.60 an hour (hard labor) even though i have all these medical conditions.

If you were not able to specify when the injury occurred and did not get workers compensation, then I am afraid you really have nobody to sue. You cannot sue an employer for injury other than in workers compensation. Your employer has a right to insist that an employee is fully capable of returning to work before returning to work, which means you need the clearance from your doctor for that. You really have nobody to sue for this. It is an injury that occurred over time and you did not pursue the workers comp claim and that was your only recourse since had you pursued that claim and received workers comp, then you could have received disabilty pay under workers comp for not being able to work.

i was told by the insurance company after they finally started by short term disability that if i was to ever go back and try to do a workman's comp claim, i would have to repay all of the money that the insurance company had paid me, is it worth it, i will be willing to repay them if i can get what is rightfully owed to me.

Under Texas law you only had 1 year from when you went out with the injury to file a workers comp claim, so I am afraid that time has long since passed.
