My husband and I purchased a time share while in Mexico in April 2006. The time share is in the state of Quintana Roo, Mexico. The price was $11,095.00 US for one week in odd years. We put 3605.00 US down payment and the balance to be paid over 60 months of $6,695.00. Payment could be made by electronic charge to a credit card or by certified cheque, cashier's cheque or money order payable to the owner in Quintana Roo in Cancun, Quintana Roo, Mexico or a post office box held by the owner in Miami, Florida. We opted to pay by credit card. We have never used this unit and probably never will. We offered to give it back and forego any monies already paid. The question: if we cease to make any further payments on this, will it have a negative effect on our Canadian credit rating and if we should travel to the US, could the authorities there detain us for non-payment? We are quite willing to deed the place back to the owners. Could Mexican collection agents come to Canada?

They would have to pursue you in Canada to have any effect. They would have absolutely no basis for trying to enforce in the united states so unless negative credit affects one traveling to the US which i have never heard of then you will be fine. It would be prohibited to get a deficiency judgment against you for less than 15k by coming to Canada, it is not reasonable. Make sure you let your credit card know not to allow them to make any further charges against the card, because they will try to i can assure you.
