Hello, I have a home in Michigan but live in California. I have renters in there currently and it is managed by a property manager. My property manager has not sent me any rent payments in 3 months and it was like pulling teeth to get just one payment 5 months ago. I am ready to fire him and take him to court to see if I can get the money obviously owed to me. I am wondering my best options. I have multiple emails and texts where he admits he owes the money and will send it but then doesn't or has some excuse why it screwed up. I would like to keep it out of court but I feel like he has to be forced by a third party to do so. So I don't know if Small Claims or arbitration is the way to go. Since I live out of state do I need to fly there to do all this or is a lawyer the better option? I would just like to meet him at his bank and cut a check since he claims it's the bank that keeps screwing up. He is only responding to emails and texts. He will not answer the phone.

His company may be headed toward bankruptcy and he doesn't want to tip you off. If I were you, I would look for a new company asap. I would also consult with a property law attorney in the MI area where the property is located. It could be that a demand letter to the property manager from the attorney would be enough to resolve the matter.
Unfortunately, if it cannot be resolved out of court, a suit would have to take place in MI unless arbitration is required under the terms of your contract with the company.

His company definitly isn't going out of business but I think he is taking the checks and spending the money before sending me my portion. How much would a typical attorney charge to contact him and attempt to resolve?
For a limited consultation, demand letter and follow-up, it should not cost more than a few hours of time at $200/hr or so. Try to negotiate a flat fee if you can.
