my wife died in January---she is being sued by a credit card company and I can't pay ---are we liable
State/Country relating to Question: Virginia Already Tried: nothing
Hello,
Were you a cosigner on the account? or an authorized user? If you were a cosigner, you are liable under the theory of "joint and several liability" which means that the creditor can could come after either or both of you for the debt. If you are just an authorized user, you are not responsible for the debt. But....the credit card debt would be a debt of her estate and as such would have to be paid out of any assets in the estate if there were any. With that said, if you and your wife owned a house together, her interest would be considered an asset of her estate and could possibly be attached. Any bank accounts that were jointly owned, could also be frozen and seized to pay the debt.
Thanks.
Matt
