I'm a contractor for a federal government agency. Last week a woman who I don't know complained that someone within my team harrassed her. She stated that it was a black and whit guy and one was wearing a blue shirt. The federal director then stated to my companies management that it had to be me and another member in our group. The person bringing the complaint has never said it was me and I believe that tomorrow I will be put on administrative leave. I did not do this and was never alone in the hallway and have co-workes who will state that. What should I do? How do i clear my name? Can I sue the federal director for syaing I did it when the persoon making the complaint never said my name or pointed me out? Please advise I need help and a good lawyer!

No, however I'm expecting to be asked for one tomorrow. I'm in the process of putting it together now. Basically it gointg to state that I did not do this and state facts in regards XXXXX XXXXX my supervisor told me was said and who stated it must have been me. Should I be proactive and write a statement? Once again, I never spoke with any females at work in the hallway and never do except for my supervisior.

Sometimes, it is standard for companies to have a policy of putting someone on administrative leave anytime there is an investigation so I would not worry too much about that. I would definitely write up a statement and state the facts as you know them. Do not be accusatory or defensive. Stick to the facts.

From what you have stated, it sounds like they are merely at the investigative stage which is what the law requires employers to do. Therefore, at this point, you do not have a basis for a lawsuit against the director.
