Hi, my name is Kim, I own a house who I rented to a doctor, he signed a one year lease and decided to extend it for another 3 years....to make a long story short, he broke his lease a year early, damaged my house. I used the deposit to hire a realtor to find another tenant, and the rest to repair the house, this doctor is verbally and metally abusive towards me, he's using his medical degree to diagnoise me and threaten me, he called me mentally not stable and is demanding that I go get mental treatment, he's is making my life hell after he distroy my house, are doctors supposed to dignoise their landlord, and use their education to threaten people, he's claiming that I'm causing his family stress and that they will need counseling. Doctors are well respected people, why is he trying to diagnoise me I'm not even his patient? I'm really stress, what do I do?
State/Country relating to Question: New Mexico Already Tried: by the way I'm a licensed realtor, but I try not to get involve in my own properties, he has threaten to take me to the RE commissioner? I don't know what to do.
He has no basis for doing so. You should proceed to sue directly or through counsel for the rent due under the lease and also for slander. Slander requires showing false statements made to another causing harm to reputation and financially. It is an expensive and time consuming lawsuit. Consider also if the defendant has any money to collect assuming you succeed and obtain a judgment. Often a lawyer letter leads to the slander to stop and is more cost effective. His wife is a law student, he's claiming that becaue I kept the deposit and also billing him for an additional 250.00 that it's a willful desire to fradulently extract financial gain, and threathen to take me to civil court and criminal court? What kind of doctor treat people like this? I know I have the right to this money but should I just give up to a bulley? he's using big words to cause me stress, I'm seriously thinking about see my doctor to get help, this guy is so verbally abusive thru his email? I wonder if this pratice is legal at the hospital where he works? What kind of laws do doctors have to obey by, where can I find it?
He is frankly abusing his position to avoid a rental obligation. You would do best to have a landlord tenant lawyer shield you from their Harassment and pursue any rent monies due.
Well, I was going to do that anyway but I can't sleep and was hoping that you can tell me where to go to find out the laws that doctors and attorneys are bound by, should I talk to his boss, let them know what he is doing?
The point here is that he confusing the issues since his being a doctor has nothing to do with his tenant obligation to pay rent. Since you are not his patient, he has no doctor-patient relationship with you and you can consider reporting him to his licensing board.
Thanks, XXXXX XXXXX still haven't answered my questions, just need to know where I can go look up his licensing board info. or code of ethics?? since his wife is a attorney am I SOL because if their profession? I feel like I've already lost, even though I'm right.
