i moved from my apt last week and had it professionaly cleaned..my landlord is refusing to return my security deposit of $450 stating their more than that in damage..this is not so..she stated that she will file with the local magistrate to collect more than the deposit..i dont have pictues but there is no way that kind of damage exists..i lived their for 5 1/2 yrsm and a certain amt of mnormal wear and tear exists...i have an invoice from the cleaning co, but again no pictures...,what is my recourse?
State/Country relating to Question: Pennsylvania Already Tried: nothing yet just ended magistrate court today...i was told by a friend that because i paid for the cleaning i may be able to recoup fropm the landlord...
SUE THEM IN Small Claims COURT, SECURITY DEPOSIT HAS TO BE RETURNED UNLESS THEIR IS SIGNIFICANT DAMAGE WORTH MORE THAN $450.00, HE WOULD HAVE TO PROVE THIS NOT YOU. THE LAW IS ALREADY ON YOUR SIDE, ALSO HIRING A CLEANING COMPANY WILL PROVIDE EVIDENCE FOR YOU THAT YOU LEFT IT BROOM CLEAN.
