(this is in new york city) My girl friend son is 19 year old and after graduating from HS, started to use drugs and sleeping in the house. she ask him to go to college and he refused. he also never located a job and she tried to find him employment but he never follow up. he ended up puling a knife on her boyfriend and threaten his mother. the mother let him back in the house and he threaten to kill his mother this time a month later . she kicked him out the house and plans on going to family court in the morning. The kid lives with his grandmother and just applied to local college and then went to welfare and now informed the mother she has to pay child support to the city. the mother plans on getting a order of protection in the morning but can she Emancipate her son and not have to worry about child support for two year?
State/Country relating to Question: New York Already Tried: one again a mother raised her son from birth. the son is 19 years old and is refusing to go to college or get a job. He pulled a knife on her boyfriend and threaten to kill his mother. She gave him another chance and allowed him to move back in to her out. this next time ne threaten his mother again and she kicked him out of the house. she wants to terminate her relationship with her son. the son signed up for college while residing with the grandmother and informed the mother now she has to pay child support because he applied for welfare. she is trying to get a order of protection right now.
Legally in NY she is liable for support until he is 21 especially if he is not living with her and he is recieving welfare. She can get the order of protection if his threats were not too long ago but she can still be ordered to pay support. He can not be emancipated if he is not working and taking care of himself.
