I live in FL, my ex in AL. We were divorced ~15years ago in AL and I have been paying permanent alimony. There is a stong possibility I will be laid off in the near future. If this happens, can I file a motion to reduce payments? Is this a difficult situation for the courts to understand? Should I have an attorney in AL or FL or both? Thanks, Tom
Good afternoon Tom,I'm sorry to hear of your dilemma.Yes, should you suffer a significant change in financial circumstances you can apply for a modification of alimony. You will need to retain an Alabama attorney local to the same court that issued your divorce decree to file the petition for you. This is a normal occurance in the court system and the judges are seeing it much more regularly with the economy being in such a shambles.I wish you the best.
