DearCustomer Thank you for contacting JustAnswer.com. Based upon the information which you have provided, I can offer to you the following suggestions: This arrangement between you and your loved one can be considered a personal loan. If you have already filed for bankruptcy, then you will need to consult with your bankruptcy attorney if you have retained such. If you are not represented, by counsel then you will need to bring this matter before the court on your own. You may file bankruptcy to discharge most debts. You may be able to add this loved one to the bankruptcy as a creditor. The problem is that your loved one will not be repaid for assisting you and will continue to have a financial obligation to the credit card company as she is the person legally responsible for the credit card. Discharge of your other debts may place you in a position to honor the agreement which you have with your loved one. Please review this matter with a local bankruptcy attorney who will be in a better position to provide you with specific details on whether or not you may add the loved one as a creditor and what motion to file to do such. I hope that you find this information to be helpful. As we have no attorney/client relationship, I can offer to you no further assistance beyond the suggestions provided. I wish you well.
