In 1968 my brother signed all paperwork to adopt out an, (at the time) unborn child. As far as the family knew the child was adopted out, my brother never paid child support to this child, etc. My brother passed away two months ago and his wife has filed a probate. This 40 year old man shows up and says he is my brothers son. The court case regarding all of this was sealed and we don't have a case number. I want to help my sister-in-law with this matter. How can I get the case number XXXXX how can I just get a letter from a judge to tell us anything about the 40 year old case that will take this "child" out of my brothers probate? If my brother signed away all his rights and the "child" was not adopted, does this "child" still have any rights to my brother's estate? (We are in the state of Oregon)
State/Country relating to Question: Oregon Already Tried: Sending a letter to Multnomah County requesting a case number XXXX all the names in the case. Ordered a birth certificate of the "child" in question. Birth certificate shows one of two and refers to a case in Multnomah county "sealed" and the case number XXX been blacked out.
To get the case number XXXXX would need to contact the court clerk's office where the adoption proceeding took place. If you cannot obtain the case number XXXXX a reasonable search, you can petition the District Court in Oregon for a declaratory judgement to the effect that there was no legal adoption. If your brother signed away his rights or the child was not adopted, the child has no rights to the estate.
