Are initials on an contract done on the Internet legal and if the service hasn't been delivered yet?
State/Country relating to Question: California Already Tried: It is a contract for an automated futures system for the mini S&P futures contracts. I was rushed through the contract and initialed it and gave them money via a credit card on Thursday afternoon, 13 Aug. (3 days ago). Upon reading the contract, it says no cancellations for any reason. I have since researched the company and found that they are affiliated with another company that has several complaints and is rated F with the CA BBB. Though the company guarantees your money back if the system isn't profitable, several complaints state that they have lost money and the company did not live up to its guarantee. They keep changing their name. I need some muscle to get my money back. I have tried calling, but get no answer at this time. Do I have any options?
Hello -Thank you for contacting JustAnswer.Could you explain your situation a little more? Thanks.Michael
Did you receive my follow up? I know that this may be the same company because it sends you to a website that the other company once used. Also, their filing with the secretary of state for California is dated 6 August. Also, on Google and its map, I can find no information on the address the company provided in Newport Beach. The name isXXXXX The affiliated company is Luxman Trading Concepts, the one with all of the complaints.
Thanks, XXXXX XXXXX recieved the follow up.Unfortunately, your signature on the contract makes it binding, unless there was some type of Fraud or duress. I'm sorry I don't have more to offer, but a signed contract is a binding agreement, and there aren't very many ways around that without breaching the contract. As a follow-up,If the contract mentioned it would not be binding before acceptance of the system, that would be your way to get out of it.Regards,Michael
I am asking if initials over the Internet is considered binding if they do not have my actual signature on anything.
Thanks for your response.Initials and signatures on a conract are the same thing. Contract law does not call for a full name as opposed to a full signature. Anything that evidences the signer's agreement to be bound by the terms in the contract will be binding. If my answer was helpful, please click ACCEPT so i may be compensated for my time.
