My daugheters apartment complex let 4-5 months go by and let her renew her lease and didn't tell her three months back rent was owed[someone stole her pin #] She couldn't pay it all so they evicted her.They said she could make payments to collections for back rent.Afterward they said she now owes 12,000 for lease [it ends in 2010] !!!They turned it over to coolections and they are going to make mine and her credit bad.She goes to college and my name is XXXXX XXXXX lease. Hi there.....Tell them nice try, but the landlord tenant law requires the landlord to mitigate damages. Mitigation means that the lessor is required to make an effort, once you give notice or are evicted, to find a new tenant. The lessor is only entitled to recover the loss of rent during the search time for a new tenant; but, once the new tenant makes the first rent payment, you have no further obligation under your lease.
