My aunt in Lincoln, Ar is not receiving the medical and mental care that she needs and has not received it for over a year. I have contacted the Adult Protective Services in Washington County and was told that in order to see that she gets the care she needs I would have to get guardianship which is costly. I want to make sure my aunt gets the care she needs and I do not want to take her away from the home she knows or the family she loves. Her son who she lives with is barely capable of caring for himself much less his mom but he loves her. Her lack of care comes from his mental state. I could not get the money to get guardianship and my mother decided not to help pay to get guardianship. What now? Does Adult Protective Services make sure she gets medical attention? Do they check on her and make sure she gets constant medical care? Do they put her in a local nursing home fo rher own good? Is she left to live the way she has been, in pain? What do I do next?
can you tell me please, have you attempted to find a low cost or free attorney to assist you on this?
Not yet. I do not want to take my aunt from her home or family. I have asked her to come here with me but she insist on staying there even though she knows she is not getting the care she needs. Some days her thought process is clear as a bell and other days she is in another world it seems but she always knows where she is at and who everyone is. I just want them to give her constant medical care and be responsible for her. They live on her SS check (rent, utilities, food) so putting her in a local home would have to be forced on my poor aunt because her son knows her checks would go there instead of to him. When we call and talk to her she usually cries and says she is in pain. Can't SS MAKE them see she gets medical care?
OK You need an attorney to assist, the good news is this is the type of case where you or she should qualify for low cost legal aid. You should start here http://www.arlegalservices.org/Home/PublicWeb/HelpLine Give a call on monday and let them know what is up. Your aunt needs help and looks like you need a lawyer to force the county to give her that help Please let me know if you have further questions; if so I will do my best to answer them. If not please hit the accept button, its the only way I get credit for my work.
