I have been married for about 15 yrs in lebanon and we had 9 yrs old boy.We then moved to the gulf area [both were working] and has accumulated good sum of money [in a joint account ].then my husband had a chance to work here in California with H1B visa and has been here for almost 2 yrs[resident of california].He got me and our son an H4 visa and we have been here only for 3 month.Things unfortunately has been deteriorating between the 2 of us very badly particularly after he lied to me and when I found out that he moved all our saving in an acoount in his name only .when I asked him about my share from the money we saved together working in the gulf area ,not any money he made here,he refused and said you can only get it as a part of a divorce ,but he is also asking for 1/2 of a furnished condo and 1/2 of a piece of land in lebanon that my father gave me as wedding gift and as part of my inheritance [boh in my name only],my questions is:does he has this right and what should I do!!
State/Country relating to Question: California Already Tried: My family has been trying to reason with him as I am only asking for my part of the money that I worked for in the gulf area ,not any of the money he made here.My fear is I am afraid that he also will cancel my H4 visa here ,not our son's one so he can force me to go back to lebanon without Him!,so I really want to know my legal right in all of this, thanks a bunch
Thank you for using JustAnswer.
First things first: the land and the condo are thankfully safe for now. He cannot take these from you with either (i) you agreeing or (ii) a judge ordering it. Both of these possibilities are doubtful, so I think you are OK here.
But yes, so long as the accounts were titled jointly, he can move and take these funds without your approval. But you are still entitled to your share of these funds. He cannot hold them hostage and demand you give him your separate property (land and condo) in exchange for your share of the jointly owned funds.
However, you will need to get a court involved now. You need to see a family law attorney and start protecting yourself. You will likely be awarded custody of your boy and given money that he took -- But again, a judge will need to order this. Thank you.
