I have lived at my residence for 26 years. I live on a large farm in Illinois. Our home and farm has been in my husbands family but was willed 2 him when his mother dies 15 years ago...5 years ago he quit deeded our home (which we remodeled & addded on at a cost of 500,000.00) to his father without my knowledge. Now I find out he has been having an affair and has filed for divorce....i am being evicted by my father-in-law (30 day notice to quit). He has taken our door locks off and has said i was dangerously aggressive to him. Not True at all......can i fight this eviction since it is technically now in his fathers name ?What happens if I stay in the house and how long can I drag this out? Thanks, diane
State/Country relating to Question: Illinois
You cannot be kicked out without court order. Notice has to be provided and court proceeding commenced. Moreoever, only the owner or owner's lawyer/agent can pursue such an eviction action. This is a standing defense. A non owner cannot kick you out, even with a court action.
