I am a registered nurse and work in a physicians office. I take an antidepressant medication. Recently my employer asked to have a list of my medications to know that I am safe to work in her office. Does she have the right to know. My job duties are taking vital signs and doing EKGs . I do not operate heavy machinery.
State/Country relating to Question: Connecticut Already Tried: The CT Labor Board says that my employer (an MD) has the right to know if I am taking mood altering drugs (an anti-depressant). This medication has had no bearing on my performance or abilities at work.
Thank you for using JustAnswer! Do you have a written employment agreement or contract?
No. It is just an antipdressant. She claims it is a mood altering drug and that she has the right to know if I am "safe" to work in her office.
Thank you. If you do not have a written employment agreement or contract, then that definitely means that you are an at-will employee. That means that you can be terminated at any time, with or without cause. Neither the federal or state government has made it illegal for a private employer to inquire what medications an employee is taking. That type of information, however, must be kept separate from an employee's personnel file. Your employer has the right to subject you to random drug and alcohol testing. Your employer has the right to ban and test you for consuming tobacco. In that same vein, there is nothing illegal about a private employer asking about what medications an employee may be taking. Good luck and best wishes! I hope that you find this information to be helpful and this answer to be ACCEPTable!
