My wife has been on maternity leave from her job since 04/17/09. She lost our baby on 6/8/09 and has been under a doctors care since then. She was preparing to return to work on 8/20/09, but her supervisor at her job and HR told her that they don't have a position for her any longer.
State/Country relating to Question: Mississippi Already Tried: We just got this info yesterday. My wife has also been under a doctors care for complications from multiple schlerosis.
Hello, and thank you for contacting the just answer team. This sounds like pregnancy discrimination to me, which is unlawful under Federal law. Under the Pregnancy Discrimination Act, Congress added pregnancy discrimination to the list (including race, gender, age, religion, national origin, disability) of prohibited types of discrimination. I would contact the Equal Employment Opportunity Commission immediately to file a charge of discrimination, and also contact an employment law attorney in your area to file suit if the EEOC is ultimately unable to help you. I hope this helps, and thank you for the opportunity to answer your question. If you have any further questions, please do not hesitate to ask. Otherwise, please remember to click the green ACCEPT button so that I can receive credit for my work. Take care
