I live in montgomery alabama and I missed my court date yesterday 8/14.I was sued by capital one due to a credit card. my son forgot to give me my mail which caused me to miss the date.I have been receiving my social security checks since I was 62.what decision did the court make since I missed the the court date? what could I do to improve my situation?

If you missed your court date, chances are that the creditor received a default judgment against you. What you must do A.S.A.P. is contact the court-house and explain that you did not receive any documents in the mail, and ask them for the form to fill out an appeal against the default decision. it will appear that I am lying if I tell them that i did not receive any documents in the mail. how else would I know about the court date?
My apologies, I meant to type that you were not properly served with documents, and that you only received the documents after the court date has passed, which is accurate. You see, if you were not aware of service, you may have a valid reason for not appearing in court, but it is up to judge's discretion--if he feels that your son was your agent, the service is valid, but if you can show you did not receive it, it is enough of a reason to try to vacate the judgment and have a re-trial.
