I work for a large technology company in the U.S. as a salaried employee. Currently, I am between assigned projects and my manager is requiring me to use up my paid vacation time because there is no work available for me. No, I don't have employment contract. The Company policy on employer/employee relationships states that "either the Company or the employee can terminate the employment relationship at any type for any valid legal reason..". California is a "Right to Work" state.
ok, I did not mean a union agreement, but in any event you are an at-will employee. As such it is legal for the employer to place this requirement on you as a condition of your employment. Legally, the anaylsis is that if you do not wish to be bound by this requirement, you can resign. Moreover, in CA vacation is considered a benefit, not a right.
