If you are in an establishment and a photographer follows you around all night making you very uncomfortable while you are tring to eat with friends and family( and will not stop taking your picture about 30 times and you repeatedly ask him too please stop)does he have to get a signed release to put them on a website?

I'm sorry to hear of your dilemma.
When you are in a public place you are unfortunately fair game for photographers. Unless your photos are used in a commercial venture--for example, in an advertisement promoting the restaurant you were in, there is no need for the photographer to obtain your release.
If you are not considered a public figure, who has fewer rights to privacy than the average citizen, you can apply for a protective order based on Harassment.
If all he does is place the photos on a website, he is not violating the law.
