I would like to know if a lawyer takes my case and writes letters to the companies on my behalf, also tells me that the company should do something by next year which is this year. Plus, my lawyer also tells me that he has contacted a friend in another state and ask for their opinion on this matter. My case was about companies sending me magazines with racial overtone in my name. Such as, Henry Dick Jackosn, that one from Victoria's Secret, also Shape has it on it's magazine also. The next magazine was Blender, with Henry Niger, on it. I also received invoice from Cosmopolitan, and from US, On both of the invoices my name isXXXXX So, my attorney started out the gate with speed back in November 13, 2008 telling me we should see something by next year. Come June 22. 2009 he tells me that I was a victim of an unfortunate and ugly prank. After all this time he tells me that, he could have told me that when I first came to him. The reason why I didn't pay a retainer is because his Dad(father) owns the business and his dad already has a case of mind case (OWCP) the dad took my case when I was working for the Postal Service. So, while I was seeing his dad I went and ask him what he thought about it. Like I said he was really excited, plus his dad said let him work on it. And to answer your question about signing anything NO, I didn't. Also, I haven't spoke to no one about this situation but you. DearCustomer It's unfortunate that nothing has happened for you. Like I said earlier, there is no guarantee that once a lawyer takes a case, you are going to come out winning anything. This is not the answer you wanted to here. At this point, you want some satisfaction for the "pranksters" who sent you those magazines. Heck, I can't relate, because I haven't had those issues, obviously. The good news is, you haven't lost any money (since you did not pay a retainer). If you really feel that you need to pursue this...Have you tried talking to the American Civil Liberties Union (ACLU). If you have a case, they would know it. As far as your question regarding the attorney's breach of contract, the answer would be no. First of all, you haven't paid them. They spent a lot of their time working for free. Secondly, there is never a guarantee that things are going to go your way. Thirdly, the laws change all of the time. What could be a good case now, may be nothing later on. Fourthly, there is no contract. You never signed a retainer. Again, I'm sorry if this is not the response you wanted to hear.
