My sister got herself into credit card debt for five thousand dollars. She has no assets except a car (an old chevy). She has no money in her checking account, and works a job for a little above minumum wage. She reneged on this debt, admittedly. She has gotten a letter of judgment against her, and now another letter from court saying they want her employer to answer certain questions. She cannot pay the debt. Will they take her car? Will they be allowed to take her wages? They claim they froze her bank account, but that isn't true. What is the worst case scenario and what should she do? I cannot pay this debt for her.
State/Country of Question: New York Already Tried: Nothing She is not worried about her credit; it is already wrecked. She just has no money to pay this debt. I know she should not have racked it up. WOuld bankruptcy be the best option? Is it too late?
Since they received a judgment against her and the court sent a letter to her employer, it sounds as though they are going to garnish her wages. They will take a % out of her paycheck, until the debt is satisfied. If they garnish her wages, there is little she can do. Any defenses she could have raised, should have been done when the case was filed against her. The car is not likely worth anything, so they will go after her wages.
