I've been a showroom manager in the tile/stone industry. I started a new full time postition (salary + commision )in July 08 with Company A, who laid me off the end of Dec. I started collecting unemployment benefits in Jan 09; soonafter Company A proposed working for them as an outside salesperson until the economy improved (and hopefully hire me back). So, since Feb, I've been on a 100% commission / no salary income. Beginning in March, I began to make some sales and was paid commission every two weeks. On those weeks, I would claim my income, but on the other weeks, I would claim an income of zero. I met TWICE with my local unempl. office and they verified that I can collect benefits as long as I was claiming income accurately each week. My concern is that some weeks I can be paid $2,000+ one week and Zero the next - ok or not? Also need to file benefits extension soon which requires a job search log to be submitted weekly - I could be hired back soon, so now what?

Department of Unemployment -- 2 different consultants who told me the same thing....... --as long as I was submitting my income week-to-week, I could claim unemployment benefits. Some weeks, I claim Zero, other weeks, $2,000 or more, which means I don't get an unemployment check that week.
HelloCustomerThe most important thing here is that you report your activity truthfully. If the UI commission finds out that you have not been honest with them, you may not only lose your entitlement but also may have to repay over payments. If your hired back to your old job soon great, then you won't need extended benefits. As far as the job log goes, you need to enter your commission sales activity and you can also add that you are reapplying to your old employer. I'm not sure what else you can do.

Also, from Feb thru May, I was claiming $200/week in income (which didn' t reduce my weekly unemployment check), but my company was paying me $400 every two weeks (as a draw against future commissions earned)....was this OK for me to do?
If I had claimed the $400 income every other week, it would have reduced my unemployment check for that week.
One more situation.... for the month of July, I stopped filing a weekly claim because I knew I was going to make some good sales for that month (which I did). Therefore my claim was closed. I haven't made ANY income for the first 2 weeks of August, however, so I reopened my claim today and plan on collecting for these 2 weeks.
Overall, a part of me feels like I'm doing something wrong despite what I've been told by DUI so just looking for as much advice as possible.

Hello again,Yes, as long as the draw of $400 was for two weeks, you could claim $200/week. Your extra issues go back to what I said before, it is imperative that you are honest. As long as you report everything you receive in income, and the system still pays you, then you are entitled to it.
