My 81 yr, old mother has gotten summons for parking tickets issued from the NY city area. They are under my deceased father's name. He has been dead since 1994. We have called them and said that our father is deceased. We sent sent letters with accompanying documention and have also had our local DMV sent a letter and call them on the phone. They have now sent a letter stating that they are taking legal action. Since all the info is for my father, can they legally go after my mother?? I don't know what they want from us. Acording to local DMV, the license # XXXXX question is defunct and has been since my father's death, when we turned in the plate. What are our legal obligations? Can you offer any guidance??
State/Country of Question: New York Already Tried: Sending letters and documention verifying my father's death. Letters and calls from our local DMV verifying everything I stated in the first message to you.
Your mother would not be liable for this and, of course, your father can't be. Even if they had been your father's tickets, your mother would not have to pay them now.Any legal action would proceed against your late father. If there's nothing in his name that can be legally attached, there is nothing that NYC would be able to get._________If I've helped, please click the green Accept button so I can get credit for my work. This thread will not close and you can always use it to get clarification. This is informational only and is NOT legal advice.
