Generally, garnishing wages is not as simple as faxing a paper. However, if a court has already issued a judgment against a debtor along with an order permitting wage garnishment, the lender may be able to simply fax the judgment to have wages garnished. Unfortunately, if such a judgment has been ordered, a person's wages may be garnished. Most lenders will work with a debtor to negotiate and settle such matters. If a debtor is uncertain as to whether a judgment and order allowing wage garnishment has been entered, she should be able to contact the local Clerk of Court. Further, she can inquire with the Clerk of Court about the exact process for wage garnishment in that jurisdiction to help her evaluate the situation.
