I've been paid $98,000 over the past sixteen months by a company involved in a class action lawsuit, they called first six months pay severance and the last ten months a consulting fee, although I haven't really provided any consulting services, basicly I was paid to lay low and keep my mouth shut because I have information that could prove damaging to their defense against the class action lawsuit. Is it legal for them to do this?
You are under no obligation to come forward and give information against your employer. If you know that they are engaged in Fraud, trying to cover something up, then you should speak up, lest you be an accomplice to this fraud. If the other side did not ask for the information that you possess, then your the company has no obligation to give it to them. But if they are trying to hide something that they should have to hand over, and you know this and do nothing to bring that to light, then you can be in trouble. So in short, it is not necessarily illegal for them to do this, but it could be depending on the circumstances, and what you know might implicate you personally. Regardless, you should get an attorney to assist you with this and to further advise you on your next course of action. I hope this information helps. Good luck to you!
