my husband just found out he wasnt the father of his son who he 's been taking care of and paying child support for 4years.he had a DNA test done after someone else started saying that they were the father.an it came back dat he was not the father.but the indiana law is crazy cause basically they say it dont matter what the dna test say he's the father cause he signed the birth certificate.so we really need sum info on what we can do to get this handle cause we dnt think its fair to still have to take care of a child thats not ours.
State/Country of Question: Indiana Already Tried: we have tried talking to other lawyers and people at the child support office.we dont know where to start
Your husband needs to file a Complaint to Determine Paternity with the Court and attach the DNA test result to the Complaint. With this complaint, he would be requesting that the Indiana Court declare that he is not the father, that his name be removed from the child's birth certificate and that his child support obligation be stopped immediately.
He needs to file the complaint in the Superior Court in the County where the child resides. The complaint form and the assistance in completing the form can be obtained at the Courthouse in the Clerk's Office.
