My now ex partner and I are renting a house, I am moving out in about a week. Yesterday we both went to the real estate agent and signed the lease over into just his name as he is staying on at the house. I also had to sign saying that the bond could be released to him at the end of the lease period as I paid all of it initially. Just to cover my back I asked him to sign a "contract" stating that he were to pay me $300 per week until the total of $1500 were paid off, as he couldn't afford to pay it to me in a lump sum. However now he is refusing to pay me the agreed amount. I have his signature on the "contract" I created. I do not want to go to court as it's not worth it for $1,500. But I want to know what I can do to ensure I receive what I am owed.
if he will not pay then you can file without a lawyer in Small Claims court and introduce the contract with his signature and you should be successful in getting a judgment against him

yes you can sue for whatever the difference is between what he agrees to pay and what is owed and you have six years in which to file suit
