FDIC STATES BANK DID UNLAWFUL COLLECTIONSCase description:I had paid after divorce decree and caught up with mortgage loan, a loan of $87k and $60k, this loan was set up as a line of credit 2001, not used until 2005, and the bank mistakenly sent to collections forgetting that the $87k was backed by property and the $60k was backed by 'cash' they had. If i did not find it they would have kept my $60k, they sent to collections and they seized it all for in matured to $73,900...putting credit on the $87k lowering to $74k, yet the Bank 'back-dated' and the 3rd party collection company being the 3rd party according to FDIC LAW STATED IT WAS ILLEGAL FOR THEM TO TAKE MONEY OUT OF MY ACCT WITHOUT MY AUTHORIZATION....there are many other mistakes and I know I will win, yet I do not have attorney and FDIC told me to get one. I just filed bankruptcy and I'm broke yet this case will win for FDIC who I talk to said they did illegal aspects and Bank of the West has been caught lying to FDIC also.
Optional Information: State/Country of Question: California Already Tried: I have asked the Bank of the West for a bill or invoice stating where money was applied and they cannot send me an official 'bill' to pay. The collection company Jonathan Neil and Assoc. took money without my authorization (3rd party) FDIC said they broke the law by doing so. Also bank of the West sent on my complaint to FDIC LIED about other issues. FDIC told me to get an attorney. I just filed bankruptcy the credit meeting was 6/24/09 so in 60 days the auto 'stay' will be over. Can I be able to sue the collection company myself for illegal withdrawal? Also Bank of the West admits they made a mistake, seized the $74k CD, back dated it, yet cannot get the loan back from the collection company? Why? Then the Bank of the west states that I pay them, yet it the check I saw, was taken out by the Collection company JNA and not bank of the west and with a signature i do not know of who it is and also drew up a company check without my authorization. Also this company I no longer own and told bank of the west how can I keep an account open on a company I do not own. FDIC is checking to see if the Bank of the West used the AIG bailout money on this loan to pay the other half also, and why in April 2008, I tried to re-fi my home and Bank of the West put down the amount of $60k that I owed which hurt me and I could not re-fi my mortgage due to it was too high. So bank of the west states to FDIC they knew all along the $60k loan was backed by my CD yet if I did not locate this $60k CD, which I forgot I did and I ran to my bookkeeper's paperwork finding yep they took it in 2001 out of my checking account cash, and not one statement was sent to me by the Bank of the West of the CD ....they stated they sent to wrong address, yet they can sure send me and send to correct address when I owe them. I had several accounts open with Bank of the West, they knew where I was. This whole thing is a 'fiasco' FDIC supports me....they told me to get an attorney, can I do it?
Just to be clear, is your question whether you can get a pro bono attorney to handle this case?
I do not know what department to file this on my own for I have paid $100k in attorney's the last 3-4 years with 5 lawsuits where my ex-husband and other's wanted my money last lawsuit was bankruptcy. I do not know what form I would use or what words I would use or what department I would file in, this is a 'win' win, case for FDIC has told me so, yet FDIC cannot fight for me they will only provide the laws. So I do not know what to do or if an atty can take a %, yet it needs to be done by 8/25/09 filed at the latest for my 60 days after the bankruptcy creditors hearing which was on 6/24/09 where I am safe for I am on a 'automatic stay' until 8/24/09....advise what would be the best I can do to do this for it has to be done.
ok, an attorney would take a case like this on contingency, meaning he/she would only be paid he/she is able to obtain a favorable verdict and from the amount awarded the attorney would take approx. 33.3%.
ok, i am in brentwood, CA zip code 94513, I have not been able to find the type of attorney that will do this, do you have any references to one>? or many? so that I can find them, I am in a new smaller area, close to SF, San Jose, Concord and Walnut Creek areas would be the closest, the further ones would be San Jose, San Francisco area. what would by the 'type' of area of an attorney who would handle this also, 'civil', 'real-estate', family law, etc??
