If you had sex with a minor 8yrs ago who said she was 18, took a dna test to establish paternity for a daughter, are those records confidential or can they be obtained in a criminal trial without consent of either parent? Me and the mother are still together but the state is trying to establish a case because of a complaint by her mother.

i found out later that she was 16 and i was 21

the statute of limitation will not be tolled until the wife is 28 (10 years after she turns 18).

i understand that part. can they courts obtain records fromt he private dna test that I took to establish parternity of the kid without my or the mothers consent?

Yes they can, if as part of a criminal investigation. Even if part of a civil claim, you would not have to consent.
