in new mexico, does the law recognize the mother's husband as the father of her unborn child even if the child is by another man?
<p>A child born during a marriage is presumed to be the child of the husband. If the husband, wife or the biological father believe this to be inaccurate, they may file a court action to have this addressed. At that point, it would be up to the discretion of the court as to whether to order a DNA test to determine true paternity.</p><p> </p><p>If that never happens, the husband will always be considered to be the father by the legal system.</p><p> </p><p>I hope you found my answer helpful.
