Customer Question

We are in the middle of a law suit with the manager of a store that we remodeled.We are also being charged with a felony. The prosecuting attorney contacted my sister-in-law and told her he hoped that our legal troubles weren't affecting the extended family. He also told her that he was sorry but that he would pursue this case to the fullest extent of the law and that he was going to go after my wife because she had to have been in on the whole deal. He also said that if she (my sister-in-law) and other members of my family wanted to sit down with him, he would explain the situation. Is it legal for a prosecuting attorney to do this?

We live in the state of Utah. He attends church with my sister in law and approached her there. I have been formally charged but not arrested. My wife has not been charged with any crime and this is the first we have heard of anything like this. Thank you

Specifically, this scenario raises alarm over violations of Utah Rule of Professional Conduct 3.8. I think that the Courts would take a rather dim view of this activity. I would encourage you to report your very valid concerns to the Utah State Bar Office of Professional Conduct.
