I have been seeing an attorney who is married , I am not.I found out he also has another girlfriend. I harrassed her on the telephone and sent her a couple of letters in the mail, letters just saying she is not his only girlfriend. This attorney told me sending the letter is a felony. Is this true Thank you.
Optional Information: State/Country of Question: Pennsylvania Already Tried: Nothing , he just found out friday and asked me if it was me and I said yes. I have been seeing him for 7 yrs
Under Title 18 USC sec. 2261A, stalking via the U.S. Mail is punishable by imprisonment of more than one year, depending upon the seriousness of the stalker's conduct, which makes the crime a felony.
However, whether the crime is punishable as a felony or misdemeanor is heavily dependent upon exactly what the letter says, and whether the alleged stalker actually engages in a "course of conduct that causes substantial emotional distress to that person or places that person in reasonable fear of the death of, or serious bodily injury..."
Hope this helps.
