I live in florida and currently have an attorney who has advised me as a mother to go to my childs fathers residence and pick her up whenever I so choose. She has been staying with her father during the summer as he is home all he time and I work full time. The problem is when I tell her I will be there she is not there and the visitation mediator says she doesn't want to come with me. My daughter is only 11 years old and I feel she is being manipulated by her father. He is an extremely controling individual who is serving probation for domestic violence against me. The injunction has expired and with it the only custody papers I had because it was temporary. What rights do i have at this point?
State/Country of Question: Florida Already Tried: mainly talking to my attorney which I am not as fond of as I was in the beginning. now 6 months later
HE FATHER IS TRYING TO ALIENATE THE CHILD FROM YOU, AND POSSIBLY PREPARE TO TAKE CUSTODY OF THE CHILD FROM YOU, YOU SHOULD FILE FOR FULL CUSTODY NOW, BEFORE THE PROBLEMS GETS WORSE THE CUSTODY ORDER SHOULD ESTABLISH VISITATION FOR HIM ON SET DAYS AND TIMES AND PHYSICAL CUSTODY FOR YOU. DO NOT DELAY AS HE WILL USE THIS AGAINST YOU.
