Under a class 1 Misdemeanor in Florida, he can serve up to a year in jail and if he has been convicted, then you would have to look at the sentence the judge imposed. If he has not been tried yet, then he needs to invoke his right to a speedy trial by having his attorney file a motion for a speedy trial. Under FL laws, for a misdemeanor, he has a right to a trial within 90 days of his arrest, but this does not begin unless he invokes this right.
