Family members own a cabin and has had access for over 50 ...

Resolved Question:

Family members own a cabin and has had access for over 50 years. A sister that owns the land that the road crosses is now putting in a fence and gate that will block access to the cabin. Is there any law that will prevent her from doing this?

Hello,Customer

You may have an easement over the sister's land due to such longstanding use of her land to access the cabin property. You would need to take legal action against her to establish that easement and require her to allow access. To do that, you would really need the assistance of a local attorney.

Hopefully, all it will take is a letter from an attorney to the sister, stating the facts and the law concerning easements, in order to get this matter settled.

Good luck to you!
