MY BUILDER HAS PUT A LIEN ON MY HOUSE BECAUSE THE BANK REFUSES TO PAY HIM DUE TO INCOMPLETION OF OUR HOUSE.THE BANK IS HAPPY TO PUT THE MONEY IN SGROW AND PAY HIM WHEN THE WORK IS COMPLETED.HE WANTS TO FORECLOSE ON THE LIEN,WHAT DO WE DO NOW?

WE RECEIVED A CLAIM OF LIEN NOTICE STATING THAT A CONSTRUCTION LIEN WAS PLACED ON THE PROPERTY THAT MIGHT STAY VALID FOR ONE YEAR UNLESS THE OWNER SHORTEN THE TIME PERIOD UNLESS THE BUILDER FORECLOSE OR DISCHARGE THE LIEN.HIS LAWYER INFORMED ME JUST NOW THAT DESPITE THE FACT THAT WE ARE WORKING WITH THE BANK ON THE AGREEMENT WE CAME TO WITH THE BUILDER HE IS GOING TO FORECLOSE? ON THE LIEN. WE AGREED THAT THE MONEY OWED BY THE BANK CAN GO INTO SGROW AND THAT THE CONTRACTORS CAN BE PAYED FROM THAT.THE BANK SAYS NO,NO MONEY WILL GO ANYWHERE UNTILL THE LIEN HAS BEEN DISCHRGED AND THAT THE MONEY CAN GO INTO SGROW AT THE TITEL COMPANY AND WILL BE PAID TO THE SUBS ON COMPLETION OF THE PROPERTY AND NOT IN A STAGGERED PAYMENT
