A tenant without a written lease is considered a month to month tenant, and they can be evicted if they do not pay the rent when it's due. In a residential tenancy, a tenant can only be removed through the court system. The amount of notice that must be given varies by state. Where is the property located?
Michigan law requires you serve the tenant with a 7 day notice to pay or leave. If they pay, they get to stay. If they leave, you can still sue for rent owed in Small Claims Court. If they stay and do not pay, then you can go to court to have them evicted. Here is the notice:
