The only condition precedent to the granting of the eviction order is that the landlord must have sent the tenant a full month's calendar notice to vacate the premises. If that has been done, then you can proceed through the court to evict, just like a breach of the lease agreement. At this point, the tenant has no legal right to be there so the eviction should be granted.
