I have been renting for 2 years from apt. complex. Smoke alarms

Resolved Question:

I have been renting for 2 years from apt. complex. Smoke alarms have been faulty since 2012. Manager has sent 3 companies to research problem, still unsolved and alarms sound often up to 20 times over one weekend. My neighbors downstairs can hear the alarms. I was offered another apartment in Sept., but now management wants to require an additional deposit and they still haven't acknowledged my dilema, which interupts our sleep and makes us uneasy about our safety. I have left a message with our County Codes Enforcement office, but I have not received a reply.

Because of this dilema and their inability to fix the alarms I have requested 2 months free rent. They said that it is not justified because of some beeping noices. I also have my 18 month old grandchild and 4 year old grandchild living with me and I am not comfortable with management's apparent disregard.

We are scheduled to move into our new apartment today, but we haven't received any response from the local management, regional or corporate office.

Please advise.

I'd prefer to settle it out of court. I am willing to report them to the better business bureau, but they're not members.

The BBB, attorney general office and dept of consumer affairs wont help here for reasons noted by you and out of their jurisdiction.

Small claims court or civil court are available.

Practically, you may or a lawyer may issue a letter with a deadline for payment before you pursue those options.

With such leverage, they may well reconsider and settle.

Martindale.com and findlaw.com are good resources.

Be sure to reference the numerous breaches with any photos and documentary evidence to show you are a serious potential plaintiff.

Do you feel my request for 2 months of compensation for my rent is reasonable since they havent repaired my smoke detectors since 12/13 nor 8/13?
