She has a direct blumberg sublease agreement with my PC and a rider to the sublease agreement that spells out the details. The rider specifically states that overtenant shall designate exam rooms and shared areas to under tenant.
Ok- if i file suit for breach of contract- is that diffierent from breach of lease?? or is the sublease with rider considered a contract?? In other words, which court has jurisdiction- landlord-tenant or civil?? or criminal??
So- it sounds like an Attorney's letter may be the first line of defense. Will they be responsible for that cost as well?? Also, just to note- this subtenant has requested 6 months ago to be let out of the sublease which we agreed to if certain conditions were met, however she never signed off on our proposal and has stayed and paid the rent. She may want to get herself evicted. Does eviction play any role here?? and can she be held liable for the remaining rent- which is 2 years left?
Im not sure I understand the last sentence- please explain. Also, it was my impression that in NY with commercial real estate- the landlord does NOT have to mitigate their damages?? What is the law on this?? I have heard conflicting responses.
