Would a proposal to carry out a car washing service on the site of an established car maintenance type operation constitute a change of use or require planning permission?

1. No, you would not need further planning permission to add a car washing area to an existing car maintenance & repair area. Essentially all uses ancillary to the main use are covered in a planning permission. There is no change of use involved in adding a car washing service to an established car maintenance operation, as both are analogous uses to car maintenance. Additionally, planning permission would only be required if there was a substantial intensification of user. However, in the normal course there is no great intensification of use in adding a car washing use to a car maintenance facility.

Customer: In a situation where the car maintenance facility is a long established but unauthorised development would a proposal to establish an analogous car washing facility be subject to a requirement to obtain planning permission?

2. Definitely yes. This is because no existing user exists to which an additional user can be added. Essentially what needs to occur here is for an application for retention be brought and the car wash should be included in this overall application. ULtimately, it will be necessary to do this at some stage, as the premises is unsaleable, as no certificate of planning compliance can be included in sale documents.
