Customer Question

My Husband won his case. thank god!
But with regard the first case where the determination was initially made for €30k what fees are due here? again he had support from a solicitor and barrister. Should the employer pay those fees also? for information it was an unfair dismissals case

1. At the outset, there is no award of costs made in an Employment Appeals Tribunal case. Accordingly, your husband will have to pay these fees out of his award before the EAT. There is no liability on the part of the employer to pay these fees. Your husband's solicitor should have explained this to him before the EAT hearing. The Appeal to the Circuit court is different, as costs rules apply in the Circuit court. However, each side bears their own costs in an EAT hearing, I regret to say. So your husband will have to pay his solicitor in this respect.
